Mr. Sayan Banerjee, learned advocate appears for the petitioner with Ms. Suparna Dutta, learned advocate.
Mr. Amal Kr. Sen, learned Additional Government Pleader appears for the State.
The petitioner was engaged as a contractual Data Entry Operator at the office of the Project Officer-cum-District Welfare Officer, Backward Class Welfare, Bankura. The engaging authority was the jurisdictional District Magistrate, Bankura. The petitioner now seeks inter-district transfer. The application of the petitioner is pending.
In view of the above, the petitioner shall serve a copy of the complete set of writ petition along with a copy of today's order upon the District Magistrate, Bankura, respondent no.8. The respondent no.8 is then directed upon issuing a prior hearing notice of at least seven days to the petitioner and after granting him an opportunity of hearing to consider the case for transfer sought for by the petitioner by passing a reasoned order in accordance with law.
In the process, if any assistance is required by the respondent no.8, he shall seek the same from the other relevant jurisdictional authorities who shall provide such assistance immediately. The entire exercise as directed above shall be carried out and completed including the passing of the reasoned order by the respondent no.8 within a period of twelve weeks from the date of communication of this order and the reasoned order shall be communicated to the petitioner within a period of one week from the date of the said reasoned order to be passed.
It is made clear that this Court has not gone into the merits of the claim of the petitioner and the respondent no.8 shall be free to decide the same with his independent mind in accordance with law.
In the event, the reasoned order goes in favour of the petitioner, the appropriate State authority shall give an immediate effect thereto but positively within a period of four weeks from the date of the said reasoned order to be passed. It is also made clear that this order shall not create any right or equity in favour of the petitioner if the petitioner does not succeed to his claim before the respondent no.8 strictly in accordance with law.
Since affidavits are not called for, the allegations made in this writ petition are deemed not to have been admitted by the respondents. With the above observation and direction, this writ petition WPA 9786 of 2025 stands disposed of, without any order as to costs.

urgent basis after completion of all necessary formalities.
