29.07.2021 Ct.32 Tanmoy Dismissed C.R.M. 4057 of 2021 In Re: - An application for bail under Section 439 of the Code of Criminal Procedure filed on 11/06/2021 in connection with NCB Crime No. 07/2019 under Section 8(C) read with Section 22(C)/29 of N.D.P.S. Act, 1985 (Special Case No.14 of 2019). And In the matter of: - Afruza Bibi @ Afruja ....petitioner.

Commercial quantity of contraband was recovered from the possession of the petitioner. Her prayer for bail was rejected by co-ordinate Benches of this Court on August 8, 2019 in C.R.M. 7041 of 2019 and by order dated July 8, 2020 in C.R.M. 4803 of 2020. We see no apparent change of circumstances after such rejections. Further, there is a statutory restriction in Section 37 of the N.D.P.S. Act.

We are also told that the trial is in progress and four witnesses have already been examined-in-chief. In view of the aforesaid, we are not inclined to allow this application.

Accordingly, the application for bail being C.R.M. 4057 of 2021 is dismissed.
