Heard learned counsels for the parties.
It appears that two FIRs were registered in respect of the same incident being Nandigram P.S. 990 of 2024 dated 9th December, 2024 and Nandigram P.S. Case No.993 of 2024 dated 9th December, 2024.
Allegations against the petitioners are identical. The petitioners have been granted bail by the learned trial Court in connection with Nandigram P.S. 990 of 2024 and seek bail in connection with the present case being Nandigram P.S. Case No.993 of 2024.
In view of the fact that the petitioners are on bail in the earlier case, they ought to be released on bail in this case also.
Accordingly, prayer for bail is allowed.
The petitioners Chandan Das @ Chandan Kumar Das, Rajkumar Mondal & Prasanta Mondal be released on bail upon furnishing bond of Rs.10,000/- each (Rupees Ten Thousand only) each, with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Tamluk, Purba Medinipur subject to condition that they shall appear before the learned trial Court on every date of hearing. They shall not intimidate witnesses or tamper with evidence in any manner whatsoever.
In the event the petitioners fail to appear before the learned trial Court on any date without justifiable cause, the learned trial Court shall be at liberty to cancel their bail in accordance with law without further reference to this Court. The application for bail is thus disposed of. Case Diary be returned.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
