Learned advocate appearing for the petitioner submits that the petitioner was falsely implicated. He submits, on instructions, that the petitioner is ready and willing to pay a sum of Rs.10,000/- per month towards maintenance of the child without prejudice to the rights and contentions. He further submits that such payment will commence from the month of December, 2021 and will be paid by the 15th of each succeeding month.
Learned advocate appearing for the State draws the attention of the Court to the contents of the case diary. Considering the materials in the case diary and considering the gravity of the offence and the complicity of the petitioner therein and considering the offer of the petitioner to pay a sum of Rs.10,000/- per month towards the maintenance of the child commencing from the month of December, 2021
and payable on 15th of each succeeding month, we grant anticipatory bail to the petitioner.
Accordingly, we direct that in the event of arrest, the petitioner shall be released on bail upon furnishing a Bond of Rs.10,000/- with two sureties of like amount each to the satisfaction of the Arresting Officer and also subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 and also subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 and on further condition that he shall meet the Investigating Officer once a week till the conclusion of the investigations.
It is clarified that this order will not prevent the appropriate forum from revising the period and quantum of maintenance noted in this order, in any manner whatsoever. The application for anticipatory bail being C.R.M. 4070 of 2021 is, thus, disposed of.
