Learned advocate for the petitioner contends that 24.06.2025 Court No. 35 M/L. 59 Rakib the petitioner is constructing dwelling house at his property after obtaining necessary permission but is being obstructed and resisted by the private respondent no.8.
Police authorities have submitted a report. Report reflects that there is a dispute between the petitioner and the private respondent who happened to be brother and sister.
Having considered that a dispute is there within the family, police authorities will ordinarily not interfer until and unless the same is directed by appropriate Court of law.
In view of the aforesaid, I do not find any scope for interference except to the extent that the police authorities would keep a strict vigil so that there is no breach of the peace and/or tranquility or any untoward incident because of the strained relationship existing between the parties.
With the aforesaid observations WPA 9854 of 2025 is disposed of.
Report submitted by the State be kept with the record.
Copy of the report be handed over to learned advocate appearing for the petitioner.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
