Learned senior advocate appearing for the petitioner seeks leave to withdraw the writ petition with liberty to file afresh on the self-same cause of action.

Bank and the respondent no.2 are represented. Learned advocate appearing for the bank submits that, proceedings under the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (SARFAESI) were taken and that the petitioners approached the Debt Recovery Tribunal under Section 17 of the Act of 2002.

W.P.A. 10674 of 2021 is dismissed as withdrawn with liberty as prayed for.
