.... for the State The writ petition has been filed for failure on the part of the respondents to take a decision on the application of the petitioner for compassionate employment.
By an order dated August 12, 2016, a Coordinate Bench of this Court had directed the Special Secretary, Panchayat and Rural Development Department, Government of West Bengal to take a decision on any recommendation for compassionate employment that may be received by him. It appears that the Deputy Director, Panchayat and Rural Development Department, Government of West Bengal had returned the proposal for compassionate employment submitted by the District Panchayat and Rural Development Officer (DPRDO) vide communication dated February 20, 2017.
Counsel for the State submits on instruction that the Office of the District Panchayat and Rural
Development Officer has not fond the petitioner's case suitable for compassionate employment.
In those circumstances, the DPRDO, respondent no.
6, shall take a decision or communicate any other final decision of the respondents, as regards the petitioner's application for compassionate employment within a period of one month from the date of communication of a copy of this order.
This Court notes that despite orders of the Co-ordinate Bench (supra), the respondents are failed to take any decision in the matter. This is very unfortunate.
It is expected that the orders of Court are complied with at least at this stage.
With the aforesaid observations, the writ petition is disposed of.
There shall be no order as to costs.
In view of the above, the CAN 1 2021 is also disposed of.
The instructions given by the DPRDO to the learned Advocate for the State are kept with the record.
Urgent photostat certified copy of this judgment, if applied for, be given to the parties upon compliance of all formalities.
