D.Hira In this case the petitioner was lastly represented on 15th September, 2017 since, thereafter, no one is appearing either on behalf of the petitioner or the opposite parties.
The case is an old one pertaining to the year 2016 and is pending in the list since 21st December, 2022.
Considering the facts and circumstances, the case is taken up for disposal on merit in absence of the parties.
Impugned in this case is an order dated 9th March, 2016 passed by the Chief Judicial Magistrate, Howrah Sadar in G.R. Case No. 4851 of 2011 under Sections 441/379/325 of the Indian Penal Code. By dint of the same, the Trial Court has dismissed the petitioner's prayer for discharge under Section 239 read with Section 240 of the Code of Criminal Procedure. The petitioner has also sought for necessary directions for quashing the FIR and the charge-sheet in Bally Police Station Case No. 724 of 2011 dated 11th September, 2011. On perusal of the entire materials available on record and the grounds made up by the petitioners I am constrained to find that the grounds thereof are not sufficient and cogent enough to warrant this Court's interference into the impugned order. Hence, in my considered opinion the revision is liable to be dismissed. Criminal Revision being CRR 1337 of 2016 is dismissed. All pending applications, if any, are consequently disposed of.
