It appears that the Controlling Authority passed its order on 16.11.2024 and the certificate was also issued accordingly due to non-compliance of the said order. It appears that vide order dated 11.09.2024, the Certificate Officer, Chandernagore, Hooghly directed payment of gratuity. Since then there is no progress in the certificate proceedings.

It appears that an appeal before the appellate authority has been dismissed vide order dated 29.04.2025.

It is submitted that a review application has now been filed by the Company on 14.05.2025 and as such the proceedings has been stalled.

On hearing the learned counsel for the parties and considering the materials on record, this writ application is disposed of with a direction that the adjudicating authority shall dispose of the review application within one month from the date of communication of this order and on disposal of the review application, the Certificate Officer shall thereafter proceed with the certificate proceedings and ensure that the proceedings are concluded within 60 days thereafter.

There will be no order as to costs.

Urgent certified photostat copy of this order, if applied for, shall be given to the parties as expeditiously as possible on compliance of all necessary formalities. (Shampa Dutt (Paul), J.)
