This is an application under Section 482 of the Code of Criminal Procedure for quashing of the proceeding of the case no.C/174 of 2013 under Section 630 of the Companies Act, 1956 now pending before the learned 4th Court of Metropolitan Magistrate, Calcutta.

The matter was taken up by this Court on April 27, 2015 when the further proceedings of the Case No.C/174 of 2013 was stayed for a period of eight weeks, which was subsequently extended for a period of eight weeks on 10th July, 2015. However, subsequent thereto, no further stay order was passed by this Hon'ble Court and the petitioner also not moved this Hon'ble Court for having further order.

Today none appears on behalf of the parties.

The matter is pending since 2015 and is running in the Warning List since 21st February, 2025.

Therefore, this Court finds no reason to keep the matter pending further.

Hence, the application being, C.R.R. 1104 of 2015 stands dismissed for default.

Let a copy of this order be sent to the Trial Court below by the Department forthwith.
