Advocate for the State, submits a report prepared by the Deputy Superintendent of Police (D&T), Krishnagar PD, Nadia.
The report reflects that the opposite parties surrendered before the jurisdictional court and they were granted bail pursuant to the order of anticipatory bail being granted in their favour.
The report so submitted also reflects that the police authorities contacted with Dr. Sajjad Hossain. It reveals that no disturbance has been created by the accused persons at his chamber, till the report was prepared on 5th of September, 2023.
In view of the report of the police authorities, I do not find that the accused persons have misused the liberty of bail granted to them and, as such, no interference is called for in respect of the application for cancellation of bail preferred at the instance of the defacto-complainant. Ld. Advocate for the petitioner submits that on 6th of September, 2023, the petitioner went to the local police station and a G.D. Entry was recorded by the police authorities.
I find that the present application for cancellation of bail relates to the order dated 16th February, 2023 and the application for cancellation of bail was affirmed in the month of April, 2023. As such, the subject-matter which is involved in the present revisional application do not involve either any perversity or any supervening circumstance, to interfere with the order of bail, so granted.
In case, circumstances so change, the petitioner would agitate before the trial court, in respect of subsequent events.
With the aforesaid observations, CRM (SB) 79 of 2023 is disposed of.
Pending application, if any, is also disposed of. The report so submitted be kept with the record.
