CRM 4117 of 2021 (Via Video Conference) 13.08.2021 Court No.28 Item No.18 (Rejected) In Re:- An application for bail under Section 439 of the Code of Criminal Procedure filed in connection with Harishchandrapur Police Station Case No. 877 of 2020 dated 07.12.2020 under Section 302 of the Indian Penal Code;

As And In the matter of : Sajjad Ali @ Sajjak Ali @ Sajak Ali.

...Petitioner

Mr. Kaustav Bagchi, Mr. Arup Sarkar, Mr. Debayan Ghosh.

...For the Petitioner.

Mr. Rana Mukherjee, Ms. Debjani Sahu.

...For the State.

The petitioner has filed the instant application for bail under Section 439 of the Code of Criminal Procedure after being arrested in connection with Harishchandrapur Police Station Case No. 877 of 2020 dated 07.12.2020 under Section 302 of the Indian Penal Code. It is really shocking and unfortunate that the son has brutally murdered by his father.

The petitioner has applied for bail as there was no corroborative evidence against him and he is unnecessary languishing in jail for nearly 248 days.

The State opposes the prayer for bail and submits that the statement of the eye witnesses would reveal and disclose the complicity of the petitioner to the alleged offence. In view of the incriminating materials having found against the petitioner, we do not think that it is a fit case where the petitioner

should be enlarged on bail.

Accordingly, the prayer for bail of the petitioner is rejected. The application for bail, being CRM 4117 of 2021 is thus dismissed.
