Matter is heard in presence of the learned advocates representing the petitioner and the State respondents. 2.
Petitioner has come up with the present writ petition seeking direction upon the concerned police authorities which would facilitate her to stay at the premises where her mother being respondent no.5 is residing. 3.
It is submitted on behalf of the learned advocate representing the petitioner that though respondent no.5 gifted the premises to the petitioner by a Gift Deed but petitioner is not being permitted to stay at the said premises.

However, the communication dated 7th May, 2026 of Inspector-in-Charge, Kalyani Police Station, Ranaghat Police District reveals a different story.

It is disclosed in the said communication dated 7th May, 2026 that respondent no.5 made complaint that she was tortured by the petitioner and bank passbook of respondent no.5 was also taken away by the petitioner with the aid of her husband.

It further appears from the said communication that there is an allegation of siphoning off ₹25 lakhs from the bank account of respondent no.5 by the petitioner. In relation
[2] thereto at the first instance, mother of the petitioner was not willing to lodge a formal complaint with the local police station due to her affection.

Meanwhile, petitioner sent a letter dated 11th April, 2026 through speed post to the concerned police authority making allegation against her mother. Subsequently, present writ petition was filed on 28th April, 2026 seeking direction upon the concerned police authorities to take steps against mother of the petitioner.

In the communication dated 7th May, 2026 it was also disclosed by the police authority that though attempt was made to contact the petitioner since it was found that there was discord in between the mother and her daughter but petitioner did not cooperate with the police authorities by making herself present before the police authorities. 9.
Thereafter, on the complaint lodged by mother of the petitioner FIR was drawn up being no.469 of 2026 dated 13th May, 2026 by the concerned authority of Kalyani Police Station, Ranaghat Police District.

Having considered the respective submissions made on behalf of the parties, concerned police authority is directed to investigate the case in accordance with law and take the criminal prosecution in connection with Kalyani P.S. Case No.469 of 2026 dated 13th May, 2026 to its logical conclusion by submitting a report before the jurisdictional Magistrate at an early date.
11. Petitioner is directed to cooperate with the police authorities in investigating the complaint lodged by the respondent no.5.
12. However, if petitioner is having right over the premises in question to stay, she shall be at leave to take steps, in accordance with law, by approaching the appropriate forum.

13. With the aforesaid directions, writ petition stands disposed of.
