, Mr. Sanjoy Mukherjee, .. for the appellant It is submitted by Mr. Mukherjee on behalf of the appellant that FMAT 399 of 2016 with FMAT 400 of 2016 were disposed of analogously by composite judgment on 28th February, 2020 by this Court but in the judgment there is no direction upon the department for remitting the Lower Court Records to the Court below.

In view of the disposal of the above numbered appeals, the department is directed to send the lower Court records to the First Appellate Court to dispose of the appeal on merit.

This order be made part of the judgment dated 28th February, 2020.
