Affidavit-of-service filed on behalf of the petitioner is taken on record.

It is submitted by the learned advocate representing the petitioner that he was initially appointed as Constable in Border Security Force (for short "BSF"). It appears that now petitioner is working as Head Constable.

It is contended that there is a pay disparity considering the pay accorded to similarly circumstanced persons working in identical post. 4.

Respondents are represented by learned advocate who has disputed the contention of the petitioner. 5.

Considering the issue involved in this writ petition no purpose would be sub-served in keeping this writ petition pending.

Leave is granted to the petitioner to make a

representation to the Inspector General, Frontier Head Quarter, BSF, South Bengal being respondent no.5 claiming pay parity considering the pay accorded to those who are holding identical posts, by fortnight from date.

If such representation is made within the aforesaid time, respondent no.5 shall decide the same in accordance with law by eight weeks thereafter and the decision to be communicated to the petitioner by fortnight thereafter.

The writ petition stands disposed of.

9.

There shall be no order as to costs.

10. Urgent photostat certified copy of this order, if applied for, be given to the learned Advocates for the parties on the usual undertakings.
