The petitioner is aggrieved by the fact that the District Inspector of Schools has endorsed on his application for transfer that the approval of alternative teacher from the higher secondary section as proposed by the Head of the Institution, requires the approval of the Commissioner of School Education.

The Court is of the view that such observation is not in accordance with law.

The Commissioner of School Education and the concerned District Inspector of Schools in consultation with the Head of the Institution to take steps to determine the alternative already proposed by the Head of the Institution.

The petitioner's application for transfer shall be considered and deal with in terms of the Rules of 2015

by the Commissioner of School Education and the concerned District Inspector of Schools within a period of six weeks from date.

The observation of the District Inspector of Schools for approval of alternative from the Commissioner of School Education as available in the portal, stall stand set aside.

With the aforesaid observations, the writ petition is disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
