Learned advocate appearing for the petitioner submits that the petitioner is an octogenarian suffering from number of diseases, but she is unable to stay at the house because of the condition particularly the first floor being incomplete. To that effect, petitioner prays that in case there is obstruction created by the private respondents being the younger son and his wife, the police authorities should render appropriate assistance.

State has submitted a report which reflects that the younger son has already filed T.S. Case No. 831/2017 before the learned Civil Judge (Senior Division), Barasat. The said case is pending for the last eight years. So far as interference in respect of the issues of privacy and/or other treatments are concerned, the same may not be interfered with by the private respondents. However, the issue relating

to construction is concerned, the same is the exclusive domain of the municipal authorities. If either the municipal authority or the civil court passes any direction upon the police authorities, the police authorities would respect, obey and implement such order. In the absence of the same, police authorities would not interfere in cases relating to construction, renovation etc. So far as the issue relating to health any interference is concerned, petitioner, if she is deprived, would inform the police authorities. Police authorities would assess the same and act in accordance with law.

With the aforesaid observations, the writ petition being WPA 9846 of 2025 is disposed of. There will be no order as to costs.
