CAN of is an application for modification and/or clarification of the order dated June 8, 2022 passed by this court in WPA No. 9453 of 2022.

The learned advocate for the petitioner/applicant submits that on the date when the writ petition was heard by this court and the order was passed, no civil suit was pending. The report filed by the police authorities wrongly mentioned that Title Suit No. 621 of 2019 was pending between the parties to the writ petition before the learned Civil Judge (Junior Division), Baruipur.

Records have been produced along with CAN 1 of 2022, from which it appears that no civil suit was pending between the parties on the day when the order of this court was passed. Therefore, the last sentence appearing in the last line of the third paragraph of the order dated June 8, 2022 with regard to pendency of a civil suit, is deleted. The order of this court dated June 8, 2022 is modified accordingly.

CAN 1 of 2022 is disposed of.
