Affidavit of assets filed by the opposite party/wife be kept with record.

Earlier on 2.12.2021 affidavit of assets was already filed by the husband/petitioner before this Court. In view of the affidavit of assets being filed by both the parties, I direct that original affidavit of assets be replaced by photostat copies by the department and the same be kept with the record. The original affirmed affidavit of assets filed by both the parties be sent back to the jurisdictional Court. The jurisdictional court would take into account the affidavits filed by both the parties before this court and freshly consider the application for interim maintenance. Till the fresh order is passed in respect of interim maintenance, the

petitioner would comply with the award of interim maintenance, which was passed by the Learned Principal Judge Family Court, Calcutta in Misc. case no.27 of 2017. The husband/petitioner and the wife/opposite party are directed to appear before the Learned Principal Judge, Family Court Calcutta on March 9, 2022. The department is directed to send the affidavits to the learned Principal Judge Family Court, Calcutta by February 22, 2022.

The learned Principal Judge, Family Court, Calcutta is directed to fix date on March 9, 2022 for complying with the directions passed above.

With the aforesaid observations CRR 1215 of 2019 is disposed of.

All pending connected application, if any, are consequently disposed of.

Interim order, if any, is hereby vacated.
