The petitioner is aggrieved by the fact that in spite of informing the police authorities for raising construction of boundary wall which is being resisted by the miscreants, no police assistance has been received by the petitioner.

State has submitted a report which reflects that police authorities apprehending breach of the peace has already drawn up proceedings under Section 126 of BNSS. It is also reflected from the records that a long standing dispute relating to the land is existing between the petitioner and the private respondents. Petitioner has expressed his agony that his boundary wall may be demolished. Police authorities would only ensure that there is no breach of the peace and/or tranquility and/or any untoward incident resulting and the miscreants

against whom allegations have been referred to do not interfere with any peaceful enjoyment of the property of the petitioner.

With the aforesaid observations, the writ petition being WPA 9855 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
