Memo of evidence filed on behalf of the State is taken on record. Learned counsel appearing on behalf of the petitioner submits as follows. There was an altercation following a dispute regarding a property between the private parties. No grievous injury was caused. The co-accused daughter of the petitioner was granted anticipatory bail by the learned Sessions Judge.

Learned counsel appearing on behalf of the de facto complainant strongly opposes the prayer for anticipatory bail. He submits that it was the present petitioner who had undressed the victim in front of all and thereafter both the accused assaulted the victim. At present, the petitioner is giving threats.

Learned Amicus assisting the State relies on the case diary and opposes the prayer for anticipatory bail. He relies on the statement of the victim and the statements of local witnesses as well as the injury report which shows, among other things, infliction of lacerated cut injuries over the chest of the victim lady.

Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail.

The application for anticipatory bail is, thus, rejected. Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
