In view of the innocuous nature of the order proposed to be passed, no prior service of notice on the opposite party is deemed necessary.

On the basis of the materials annexed to the present application under Article 227 of the Constitution of India, the petitioner has made out a strong prima facie case as regards the suit filed against the petitioner being dragged indefinitely without any plausible rhyme or reason.

In such view of the matter, C.O. 1200 of 2021 is disposed of by directing the Civil Judge (Junior Division) at Amta, District-Howrah, to dispose of Title Suit No.5 of 2017, along with all interlocutory matters, if any, as expeditiously as possible, positively within six months from the date of communication of this order to the court below.

This direction is peremptory and mandatory in nature and the trial court shall act on the communication of the learned advocate for the petitioner along with a server copy of this order, without insisting upon prior production of a certified coy.

The petitioner shall communicate this order to the trial court as well as to the opposite party within a week from date.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
