And In the matter of: Ela Box Mondal .... Petitioner Md. Younus Mondal ... For the Petitioner Ms. Sukanya Bhattacharjee, Mr. Nirupam Dhali ...For the State By the order impugned dated February 24, 2021, learned Judicial Magistrate, 1st Court at Barasat, North 24 Parganas has issued a warrant of arrest against the petitioner for his absence on February 24, 2021 before him.

Learned advocate appearing for the petitioner submits that the petitioner is ready and willing to appear before the learned Magistrate on the next date of hearing and he could not be present before the court below due to lack of communication.

Ms. Sukanya Bhattacharjee, learned advocate, appears for the State. After hearing the respective parties, I dispose of this revisional application giving a direction upon the petitioner to surrender before the learned Magistrate within a period of six weeks from date and stay the operation of the warrant for six weeks.

If the petitioner appears in compliance with this order before the learned Magistrate, his prayer for bail will be considered in accordance with law. In default, the warrant issued against him shall revive and the learned Magistrate will be at liberty to execute the same.

The revisional application being CRR 1365 of 2021 is disposed of.
