After considering the affidavit which has been filed by the petitioner and the report submitted by the State, I am of the opinion that further continuance of the proceedings are unwarranted before the Learned Magistrate.

Accordingly, case no.CR 159 of 2005 pending before the Learned Chief Judicial Magistrate, Murshidabad, is hereby quashed. Thus, CRR 1449 of 2018 is allowed.

All pending connected applications, if any, are consequently disposed of.

Interim order, if any, is hereby made absolute. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
