Learned advocate appearing for the petitioner submits that there has been alleged recovery of 2548 grams of Brown Sugar in the present case and the petitioner is in custody for more than ten months. Although charge-sheet has been submitted, but till date charges have not been framed and the petitioner is unnecessarily detained in custody. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail as some of the accused persons are absconding.

Learned Special Court is directed to exhaust the process of law and if required, split up the trial of the case. Learned Trial Court would ensure that the stage of consideration of charges is over within a period of three months from the date of communication of this order.

Priority be granted to examination of seizure list witnesses preferably within a period of 45 days after the stage of consideration of charges is over.

At this stage, the prayer for bail of the petitioner is rejected.

Petitioner would be at liberty to approach this Court after the aforesaid time period is over.

The application for bail, being CRM (NDPS) 876 of 2026, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
