C.R.R. No.1195 of 2017 D/L41 March 10, Bpg.

In Re: An application under Section 401 read with Section 482 of the Code of Criminal Procedure;

Sri Santosh Kumar Ray

Versus

The State of West Bengal & Ors.

Mr. Arijit Ganguly, Ms. Debjani Sahu.

...for the State.

The revisional application number has been inadvertently typed in the cause title of the revisional application in the order dated 24.02.2022. The correct number should be read as "CRR 1195 of 2017" in stead of "CRR 1195 of 2020". Report submitted by Mr. Ganguly, learned advocate appearing for the State be kept with the record. None appears for the petitioner.

I find that the case was initiated in the year 2010 and the learned special court by an order dated 28.02.2017 was pleased to refuse the prayer for further investigation. By the same order, learned special court was pleased to direct the defacto complainant of the case to address his grievance before the civil forum. The order dated 28.02.2017 reflects that the conclusion of the investigating officer was also accepted by the learned special court.

In view of the aforesaid, I do not find any reason to belatedly interfere with the merits of the order so passed.

Accordingly, CRR 1195 of 2017 is dismissed.

Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
