For the State The petitioner has filed the instant application for bail under Section 439 of the Code of Criminal Procedure in connection with Bagdah Police Station Case No. 472 of 2019 under Section 21(c) of the NDPS Act. Indubitably, commercial quantity of contraband was recovered from the possession of the petitioner. We, thus, do not find any ground to take exception to Section 37 of the NDPS Act.

The application for bail is, thus, considered and rejected. However, we have found that out of 11 charge-sheeted witnesses, 3 witnesses have been examined. We are further told that the next date is fixed on 18th August 2021.

The learned Special Judge in the trial Court is requested to take up the matter on the said date so fixed and all endeavor shall be shown to bring the case to its logical end within 8 months from the date thereof. (Harish Tandon, J) (Bibek Chaudhuri,J.)
