23.08.2021 Ct.32 Tanmoy Rejected C.R.M. 4161 of 2021 In Re: - An application for bail under Section 439 of the Code of Criminal Procedure filed on 18/06/2021 in connection with N 56/20 arising out of Lake Town Police Station Case No. 37/2020 dated 25/02/2020 under Sections 21(ii)(C)/ 29 of the N.D.P.S. Act, 1985.

Commercial quantity of contraband items was recovered from the possession of the petitioner. In view of the statutory restriction in Section 37 of the Narcotic Drugs and Psychotropic Substances Act, 1985, we are not inclined to entertain the petitioner's prayer for bail. However, the petitioner says that there has been no progress in the trial after framing of charge. The petitioner has been in custody for 1 year and 6 months. Considering the facts and circumstances of the case, we request the learned trial Court to expedite the trial to the extent possible and bring the same to its logical conclusion as soon as the business of the Court may permit and preferably within a period of one year from date.

Accordingly, the application for bail being C.R.M. 4161 of 2021 is dismissed.
