Learned advocate appearing for the petitioner submits that the petitioner is in custody for about 6 months and the subject matter of alleged recovery in the present case is 25 bottles of phensedyl. Charge-sheet has been submitted and the prosecution has relied upon 11 witnesses in order to prove its case which will consume substantial amount of time.

Learned advocate for the State opposes the prayer for bail.

I have taken into account the period of detention, chargesheet having been submitted and 11 witnesses being relied upon by the prosecution, I am of the opinion that some time will be required to take the trial to its logical conclusion.

Accordingly, the prayer for bail of the petitioner is

allowed. The petitioner, namely, Saddam Hossain @ Bania shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned special court under NDPS Act, Raiganj, Uttar Dinajpur. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Uttar Dinajpur without the prior permission of the learned special court. Thus, CRM(NDPS)885 of 2026 is allowed.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
