Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 8 months and the subject matter of the case relates to alleged recovery of 37 bottles of codeine phosphate. Learned advocate submits that the charge-sheet has been submitted and charges have been framed and the prosecution has relied upon 15 witnesses in order to prove its case as there is no scope of trial concluding in near future, the petitioner may be released on bail on any stringent conditions. Learned advocate for the State opposes the prayer for bail and submits that the petitioner has one criminal antecedent.

Having considered the tender age of the petitioner, the quantity of seizure in the present case and the period of detention as also the fact that some time will be required to take the trial to its logical conclusion, I am inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Sagar Kumar shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, special court under NDPS Act, Purulia. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Purulia till further orders of this Court. Additionally, the petitioner will once in a month meet with the Officer-in-Charge or any police personnel assigned by the Officer-in-Charge of the Purulia Town Police Station till further orders of this Court.

Thus, CRM(NDPS)888 of 2026 is allowed.
