In view of the admitted position that the appellant had applied for transfer when the Transfer Rules 2015 was in operation and the application of the appellant is required to be considered in terms of the Transfer Rules 2015. We set aside the order under challenge and direct the Chairman, the West Bengal Central School Service Commission, to decide the application for transfer in terms of Transfer Rules 2015 within a period of four weeks from the date of communication of this order by either of the parties.

On such consideration, the appeal being MAT 714 of 2023 stands disposed of.

In view of disposal of the appeal, nothing remains to be decided in the application for stay being CAN 1 of 2023 and the same is accordingly disposed of.
