Shri U.K. Sahoo (Via Video Conference) Mr. Pushpal Chakraborty, Mr. Arkadipta Sengupta, Ms. Prisanka Ganguly .... for the petitioners Mr. Avinash Kankani .... for the alleged contemnor Learned counsel for the petitioners submits, in his usual fairness, that the direction of this court was complied in view of the alleged contemnor having passed an order in respect of the matter in the meantime.

However, it is submitted that the alleged contemnor as named in the contempt application has since demitted office and some other incumbent has taken charge. As per prayer of the learned Advocate for the petitioners, the learned Advocate for the petitioners is granted leave to carry out consequential

amendments to the cause title of the application, impleading the present incumbent to the post, during the course of the day. Since the alleged contemnor is represented by Mr. Kankani, learned counsel, who submits that he also has instruction to appear on behalf of the present incumbent, there is no use keeping the matter pending unnecessarily.

Accordingly, CPAN No.417 of 2021 is dismissed as infructuous, with liberty to the petitioners, if they so intend, to challenge the subsequent order passed by the alleged contemnor by way of a fresh writ application. This order will not come in the way of such fresh writ petition, if filed, being adjudicated on its own merits.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
