APP Ms. Rita Datta ...for the State It is submitted on behalf of the petitioner that 39.870 kgs. of ganja was allegedly recovered from the joint possession of the three accused persons and the present petitioner is one of them. He further submits that he is in custody for about nine months and the charge-sheet has already been submitted but charge has not yet been framed and nobody knows when the trial would be concluded and as such, he may be released on bail on any terms and conditions. Learned counsel for the State opposed the prayer for bail contending that the commercial quantity of narcotic substance has been recovered from the joint possession of the present petitioner and that trial is going to commence shortly. Having considered the submissions made on behalf of both the parties and that rigour of Section 37 of the NDPS Act clearly attracts in respect of the present petitioner in the

instant case, the prayer for bail made by the petitioner is rejected.

However, the Trial court is requested to expedite the trial as expeditiously as possible, keeping it in mind that the valuable right to speedy trial has been guaranteed to the petitioner under Article 21 of the Constitution of India. Accordingly, CRM (NDPS) 528 of 2025 is disposed of. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
