C.R.M. (M) 445 of 2025 In Re : An Application under Section 439 of the Code of Criminal Procedure/under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Md. Bazar Police Station Case No. 206 of 2017 dated 20.09.2017 under Sections 147/148/149/341/448/323/325/326/379/307/506/427 of the Indian Penal Code.
And In Re : Nur Kalam Sk. @ Tara Mr. Sekhar Kr. Basu Md. Ashraf Ali Gulam Mohiuddin ... For the Petitioner.
Adil Badr Parvej Anam ... For the State Mr. Jayanta Narayan Chatterjee Mr. Sirshendu Sinha Roy Mr. Bitasok Banerjee Supreeem Naskar Ms. Jayashree Patra ... For the Defacto Complainant The petitioner is in custody for a year and renews his prayer for bail.
Learned counsels for the State and the defacto complainant oppose the prayer.
In rejecting the bail prayer of the petitioner on 13th November, 2024 this Court has observed that suppressing rejection of successive anticipatory bail applications by this Court the petitioner persuaded the learned Sessions Judge to grant anticipatory bail. Such anticipatory bail was cancelled subsequently. The petitioner filed a Special Leave Petition before the Hon'ble Supreme Court which was
dismissed in March, 2022 after which he again absconded for two years. Criminal antecedents of the petitioner and his involvement in the present offence have been recorded in the earlier order. In the event the petitioner is released on bail at this stage, chances of his further abscondence cannot be ruled out.
Considering the material on record as well as the conduct of the petitioner, prayer for bail is rejected at this stage.
The application for bail is disposed of.
Case diary be returned.
Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
