Learned advocate appearing for the petitioner submits that the petitioner was initially arrested and alleged recovery of 642 grams of Heroin was foisted upon the present petitioner. There was subsequent recovery of 339 grams from another accused who has been released on bail on 22.04.2026 in CRM(NDPS) 664 of 2026.
Learned advocate appearing for the State, on the other hand, opposes the prayer for bail.
I find that the principle on which the other accused has been granted bail in CRM(NDPS) 664 of 2026 too also apply in respect of the present petitioner. Accordingly, the present petitioner viz., Abdul Malek @ Md Malek @ Malek be released on bail by the learned Trial Court on the same terms and conditions as the other accused who has been granted bail in CRM (NDPS) 664 of 2026.
Accordingly, the prayer for bail of the petitioner is allowed.
The application for bail, being CRM (NDPS) 889 of 2026, is, thus, disposed of.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
