The grievance of the petitioners is that there was some difficulty of the ld. lawyer, an accommodation was prayed for cross-examination of P.W.2 and the ld. trial court has expressed its dissatisfaction.

I have considered the dissatisfaction recorded by the ld. trial court. However, for the greater interest of justice, I direct that the petitioners be allowed to cross-examine the P.W.2. A particular date be fixed by the ld. trial court on deposit of Rs.5,000/- as cost.

Let the cross-examination of P.W.2 be completed on a single date after recall. No further accommodation be granted to the petitioners.

It is directed that, in case, the order is brought to the notice of the trial court within a period of six weeks, the cross-examination of p.w.2 must be completed on condition as above.

With the aforesaid observations, CRR 1514 of 2023 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order, duly collected from the official website of the Hon'ble High Court, Calcutta.

Urgent Photostat certified copy of this order, if applied for, be supplied to the parties, subject to compliance with all requisite formalities.
