Learned advocate appearing for the petitioner submits that the petitioner has been arrested on the basis of statement of coaccused and there has been no recovery from the present petitioner. Already 7 witnesses have been examined but the prosecution has relied upon 17 witnesses in order to prove its case, as such petitioner may be released on bail.
Mr. Rajendra Banerjee, learned Additional Public Prosecutor along with Mr. Ramashis Mukherjee are appearing for the State. Their appointments may be regularized by the concerned authorities.
Learned advocate appearing for the State opposes the prayer for bail and submits that the subject matter of recovery in the present case is 2000 bottles of phensedyl. Although, the recovery is not from the possession of the present petitioner but he is thickly
connected with the alleged offence. Petitioner has criminal antecedents and as such, his prayer for bail may be rejected. I have taken into account the submissions of the respective parties and the fact that the petitioner has been implicated on the basis of statement of the co-accused, as such, I am inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner is allowed.
As such, the petitioner, namely, Abdul Hakim Mondal @ Abdul Hakim Molla shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court (under NDPS Act), 8th Court, Barasat, North 24 Parganas. If on bail, the petitioner shall be physically present on each and every date before the learned Trial Court and shall not leave the jurisdiction of district of North 24 Parganas without prior permission of the learned Special Court.
Thus, CRM (NDPS) No. 877 of 2026 is allowed.
