1. After some submissions learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to avail appropriate legal remedies.

2. Learned counsel for the opposite parties has informed that opposite party no. 4 Somenath Majumder has expired on 11th June, 2025, after passing the judgment. Learned counsel further

submits that Pushpita Apartments Flat Owners' Welfare Association has nominated Mrs. Alpana Bhattacharya being the Secretary of the association to represent.
