Mrinmoy Biswas v. State Of West Bengal And ORS.
07.08.2023 (M/L-44) Ct.-18 (Susanta) W.P.A. 9910 of 2023 Mrinmoy Biswas -Vs- The State of West Bengal & Ors.
Mr. Srwar Jahan, Mr. S. N. Thander, .... For the Petitioner.
Mr. Rasarshi Basu, Mr. S.T. Mina, .... For the State.
The petitioner is an Assistant Teacher of Taranipur High School, District-Nadia.
In terms of the order dated August 18, 2017 passed in W.P No. 21237(W) of 2017, the District Inspector of School (S.E), Nadia, the respondent no. 9 herein by the order impugned dated September 26, 2022 has disposed of the representation of the petitioner praying higher scale of pay.
The respondent no. 9, by the said order has refused to grant the relief as prayed for on the ground that in terms of the G.O. No. 593-SE(B) dated November 27, 2007 of School Education Department, West Bengal, the petitioner is not entitled to such higher scale of pay as he joined the school as Pass Graduate Teacher of Bengali and completed his M.A.(Part-II) Examination in correspondence after taking casual leave from the School on examination days.
This Court does not find any illegality and/or infirmity in the order impugned warranting interference.
W.P.A. 9910 of 2023 is dismissed without any order as to costs.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
