Mr. Arani Bhattacharyya ...... for the State Having considered the materials on record including statements of witnesses and contemporaneous document namely, seizure list prima facie disclosing recovery of 305 bottles of phensedyl syrup containing codeine phosphate above commercial quantity from the petitioner, we are of the opinion in view of the aforesaid facts and in the light of the statutory restrictions Section 37 of the N.D.P.S. Act, this is not a fit case to grant bail to the petitioner.
