West Bengal State Electricity Distribution Company Ltd. and others Ms. Sayantanee Bhattacharjee .... for the petitioner Mr. Mihir Kundu .... for the WBSEDCL Mr. Rajib Ghosh .... for the private respondent no.4 Learned counsel for the petitioner argues that despite the petitioner's father, since deceased, having taken a specific objection to the effect that the electricity meter through which the connection has been given to the private respondent, is in a dangerous condition and seeking shifting of the same, the Distribution Licensee has not yet taken any steps thereon. It is urged that, in view of the dangerous condition of the said meter room, the meter may be shifted immediately to some other alternative location. Learned counsel for the private respondent submits that, in the meantime, pursuant to an order

passed by a civil court in a partition suit, the private respondent has already constructed a new meter room which has taken care of the safety and security issues of the electricity meter.

Learned counsel appearing for the Distribution Licensee, that is, the West Bengal State Electricity Distribution Company Ltd. (for short "WBSEDCL") hands up a copy of the order of the civil court as well as a written instruction from his client corroborating the stand taken by the private respondent.

Hence, it is seen from the materials which have been filed today in court and kept on record that the cause of action for shifting the meter has been addressed in the meantime by reconstruction of a new meter room.

Hence, WPA No.9540 of 2022 is disposed of by granting liberty to the petitioner to approach the appropriate authorities, in the event some future safety and security risks are posed to the petitioner. There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
