Versus

The State of West Bengal & Ors.

Mr. Sudip Ghosh Chowdhury, Mr. Sanjoy Bhattacharya ...for the Petitioner.

Mr. Pantu Deb Roy, ld. AGP Mr. Subrata Guha Biswas ...for the State-respondents.

Affidavit of service is taken no record.

The petitioner has alleged inaction on the part of the Inspector-in-Charge, Chandannagar Police Station. According to the petitioner, even though the prayer for anticipatory bail of her husband was rejected by the competent court, the police authorities failed and neglected to take steps by apprehending the miscreant and also by proceeding further with the investigation. Necessary order directing arrest of the accused, is being prayed for.

Mr. Deb Roy, learned Additional Government Pleader, appearing on behalf of the State-respondents, submits a report. It appears that Chandannagar Police Station Case No.106 of 2022 dated April 29, 2022 under Sections 498A/406/308/34 of the Indian Penal Code and Section 4 of the

Dowry Prohibition Act, has been registered against the husband of the petitioner. The police report is taken on record. It also appears that investigation is going on and the injury report was also collected by the police authorities. The petitioner's husband was arrested on May 24, 2022. Under such circumstances, this Court finds that the police authorities have taken steps in the matter. However, the authorities must conclude the investigation, which has been initiated, in accordance with law, independently and expeditiously.

The writ petition is, thus, disposed of.

There will be no order as to costs.

All parties are to act on the basis of the server copy of this order.
