Learned advocate appearing for the petitioner submits that the petitioner is in custody since 07.11.2024 and has been implicated for alleged recovery of 298 grams of Heroin. Charge-sheet has already been submitted before the jurisdictional court; the prosecution has relied upon 14 witnesses in order to prove its case. Although charges have been framed, but till date, witness action has not commenced.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail.

Having considered the report which has been submitted on behalf of the State and there is no instruction to the learned advocate for the State that there are any

antecedents of the present petitioner and also considering the period of detention of the present petitioner, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed.

Accordingly, the petitioner viz., Jahangir Sk. @ Kalu shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under the NDPS Act, 2nd Court, Berhampore, Murshidabad.

If on bail, the petitioner shall be physically present on each and every date so fixed by the learned Special Court and shall not leave the jurisdiction of the district of Murshidabad without prior permission of the learned Special Court.

Memo of Evidence submitted by the State be kept with the record.

Mr. Gouranga Kumar Das, learned APP along with Ms. Nayana Mukhopadhyay, learned advocate is directed to appear for the State. Their appointment may be regularised by the concerned authorities.

The application for bail, being CRM (NDPS) 883 of 2026, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
