20.06.2025 Ct.No.34 b.das Rejected C.R.M. (M) 353 of 2025 In Re : An application for bail under Section 483 of BNSS, 2023 filed in connection with New Barrackpore Police Station Case No.261 of 2023 dated 29.09.2023 under Sections 368/370(A)/120B/427/506/109/376D/34 of the Indian Penal Code read with Section 5 of the Immoral Traffic (Prevention) Act, 1956.

And In Re :

Moyna @ Bidisha Biswas ... Petitioner.

Mr. Krishan Ray Mr. Sekhar Mukherjee ... for the petitioner.

Mr. Randeb Sengupta Mr. Akash Ganguly ... for the State.

Report submitted by the State is taken on record. Heard learned counsels for the parties.

The petitioner is in custody for more than a year and prays for bail.

Learned counsel for the petitioner submits that the petitioner is the mother of a one and half year old child who has none to look after. The petitioner has no involvement in the alleged offence. The principal accused is her husband. Learned counsel for the State opposes the prayer. I have considered the material on record. The victim has implicated the petitioner and her husband in the alleged offence. 5 out of 15 witnesses have been examined. The witnesses have also implicated the petitioner.

Considering the nature and gravity of the offence and prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage.

The application for bail is thus disposed of. Case diary be returned.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
