It has been submitted that there are several vacant posts on clerical staff in the municipality and that the case of the petitioner may be considered for regularisation.

The petitioner has failed to produce any supporting law which permits regularisation of any employee appointed without initiating regular recruitment process. The petitioner may be in service for a considerable period of time, but that will not entitle her to seek regularisation in the concerned post in the absence of law permitting the same.

In the event the municipality initiates recruitment process in future, then the petitioner may be permitted to participate in the process condoning her age bar.

WPA No.9931 of 2023 stands disposed of.

Certified copy of this order, if applied for, shall be made available to the parties.
