Singh ... for the State-respondent(s) Learned advocate for the petitioner submits that from the exclusive possession of the petitioner there has been alleged recovery of 11.190 kg of ganja. The petitioner is a lady having two minor children.

The petitioner is innocent of the charges and accompanied her husband when she was intercepted. Learned advocate also submits that charge-sheet has already been submitted before the learned jurisdictional court and the prosecution has relied upon 11 witnesses, as such, there is no possibility of the trial being concluded very soon. Therefore, learned advocate prays that the petitioner may be released on bail on any stringent condition.

Learned advocate for the State submits that from the joint possession of three persons 33.564 kg of ganja were recovered.

Having considered the quantum of seizure in the present case, which is of commercial quantity, I am not inclined to enlarge the petitioner on bail.

Hence, the prayer for bail of the petitioner is Rejected.

However, the petitioner will be at liberty to renew his prayer for bail after the evidence of the seizure list witnesses is over.

State is directed to take steps so that the stage of consideration of charges is over within a period of 45 days from the next date fixed. The seizure list witnesses should be given priority so that within next 45 days from the next date fixed, the evidence of the seizure list witnesses is complete.

Accordingly, CRM (NDPS) 891 of 2026 is dismissed. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
