Affidavit of service filed on behalf of the petitioner be kept with the record. None appears on behalf of the State respondents in spite of service.

The petitioner is the widowed daughter of an Assistant Teacher of Naikuri Thakurda Institution, District-Purba Medinipur, on attaining the age of superannuation, the said teacher had retired on December 31, 1968 and died on October 12, 1988. The mother of the petitioner has also died on February 18, 2014. Now the petitioner is praying family pension.

Jana, learned advocate for the petitioner submits that in view of the judgment of the Special Bench of this Court in the case of THE STATE OF WEST BENGAL & ORS. vs.

SABITA ROY, the petitioner is entitled to get such family pension.

Be that at it may, to avoid the future complication, the petitioner is directed to lodge a formal claim for family pension before the school authority within a week from date.

The school authority, on receipt of the said application of the petitioner, shall immediately transmit the same to the District Inspector of Schools (S.E.) District-Purba Medinipur, the respondent no.3 herein who shall take steps to dispose of the said application within four weeks from the date of receipt of it.

W.P.A. 10814 of 2024 is disposed of with the above terms without any order as to costs. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
