The main grievance of the petitioner is in respect of the common pathway being obstructed at the behest of the private respondents.

I have considered the representations made by the petitioner addressed to the higher officials including the Officer-in-charge of Haldia Women Police Station.

State has submitted a report

prepared by the Inspector of Police, Haldia women Police Station which reflects that there is a family dispute for which a case under Section 498A/323/506 of the IPC has already been registered.

So far as the obstruction in the common passage which is one of the allegations of the petitioner is concerned, it has been referred to in the police report that western side of the petitioner's residential house is completely open for all and no obstruction is created by any one.

In view of the aforesaid, if the petitioner wants to dispute the contents of the police report so far as the obstruction is concerned, she will file an appropriate application before the jurisdictional court - both civil and criminal. The concerned court on an assessment of the facts will take a decision as to whether any interference is required to be called for.

With the aforesaid observations,

WPA 10802 of 2024 is disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with the record. A copy of the report be handed over to the learned advocate for the petitioner.
