Learned advocate appearing for the petitioner submits that, apart from Section 326 and all other provisions are bailable. He submits that, the police filed charge-sheet and, therefore, custodial interrogation of the petitioner is not required. Moreover, some of the co-accused are on bail. Learned advocate appearing for the State draws the attention of the Court to the injury report and the statement of the victim.

Considering the injury report and considering the fact that some of the co-accused are on bail and considering the involvement of the petitioner in the incident as it transpires from the statement recorded under Section 161 of the Code of Criminal Procedure of the victim, we are unable to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM 4212 of 2021 is dismissed.
