Kasmira Bibi v. Md Firoj Ali The Officer In Charge Rabindranagar Ps And ORS
19th July, (AK) WPCRC 89 of 2024 (CPAN 701 of 2024) In WPA 23683 of 2023 Kasmira Bibi Vs.
Md. Firoj Ali and others Mr. Indranil Halder ...for the petitioner.
Ms. Sonal Sinha Mr. Avishek Prasad ...for the alleged contemnor no.1.
Mr. Debanjan Mukherjee ...for the alleged contemnor no.2.
Mr. Indrajit Bhattacharjee ...for the alleged contemnor nos.3 & 4.
1.
The alleged contemnors are present in court today. 2.
It is submitted by learned counsel for the alleged contemnor no.3 that the said alleged contemnor is physically not in a position to resist the electricity connection being given to the petitioner.
3.
Rather, there is an animosity between the parties in view of a civil suit pending between them.
4.
Since the alleged contemnors are present in court today and their demeanour indicates that they are repentant for any resistance to the court's order, if at all, as well as keeping in view the fact there is
some doubt as to whether they actually resisted the electricity connection from being given physically, this court is of the opinion that benefit of doubt should be extended to the alleged contemnors. 5.
In any event, as the order of this court has ultimately been complied with by giving electricity connection to the petitioner, no further purpose of justice would be sub-served in keeping the Rule subsisting.
6.
Accordingly, WPCRC 89 of 2024 is discharged.
7.
CPAN 701 of 2024 stands automatically disposed of.
8.
Further personal appearance of the alleged contemnors is, hence, dispensed with.
